Unilin Responds to Faus

Hannover, Germany, January 17, 2007—Unilin has reacted to comments made late last week by Faus. Unilin said it has enforced a summary injunction against Faus for patent infringement on EP 1 223 267. It said the injunction of the Landgericht Hamburg injunction on January 12, 2007, forced Faus to have all infringing flooring panels removed from the company’s stand at Domotex. Unilin said that a cross license agreement with Faus had been in place since 2004, but it said, it was terminated by Faus at the end of 2005. Shortly thereafter, Unilin said, Faus sued Mohawk and Unilin in the U.S. Since then, Unilin said, it has tried to renegotiate the agreement in good faith with Faus. Unilin said the negotiations broke down when Faus involved 18 Unilin U.S. customers in that legal action in Atlanta (U.S.) in December 2006. Unilin said when it discovered that Faus was installing infringing floor panels during the Domotex show, it was forced to take this action.
