Pergo Infringment Case vs. Balterio Dismissed
Viken, Sweden, June 29, 2011 -- The district court of Düsseldorf dismissed last week the patent infringement case of Pergo vs. Balterio on Välinge´s 5G original technology, according to a Valinge press release.
The case was based on a Pergo´s European patent and German utility model. An opposition proceeding is pending against the patent and cancellation requests have been filed against the utility model.
Balterio said in its own press release that the ruling will allow it to freely market its “Grandeur” floor panels in Germany without infringing Pergo’s patent rights. The court also decided that Pergo has to bear the statutory costs of the legal proceedings.
Välinge said it supported Balterio in its legal defence against Pergo.
