Pergo: Click-Joint Dispute Now Closed

Trelleborg, Sweden, May 27—Pergo said today that as it had announced earlier, the Court of Appeal for the Federal Circuit in the United States has affirmed the ruling from the US International Trade Commission (ITC) from March 2002. The company said that on May 24, the US Supreme Court denied the counterparts’ petition for appeal of the Federal Circuit’s affirmation. There are no remaining ways of appeal and the case is thereby finally closed. The ruling says that joints manufactured by Pergo under licence from Unilin do not violate the patent held by Välinge Aluminium AB. The ruling means that Pergo is free to import and sell products with these joints in the US without restrictions.
