Foam Products Sues for Patent Infringment

Calhoun, GA, Jun. 7--Foam Products Corp. announced today that it has filed a patent infringement lawsuit against Healthier Choice Carpet and Cushion, Inc., a supplier of underlayments for floorcoverings. The suit was filed in June in the United States District Court for the Northern District of Georgia in Rome. The suit was served following various discussions between the parties. In the suit, Foam Products seeks monetary damages and an injunction that will bar Healthier Choice from further violation of Foam Products’ patent. The suit concerns U.S. Patent No. 6,576,577, entitled “Underlayment for Floor Coverings,” which was awarded to Foam Products in 2003. The patent covers various underlayments used in the floorcovering industry. The underlayments reduce impact sound and floor-to-ceiling noise and are far easier to install than prior products. “Patents are obtained by Foam Products to protect the superior technical capabilities that we have created with our R & D investment” said Ken Garner, Foam Products’ Vice President and General Manager. “As demonstrated by this suit, we will enforce our intellectual property rights as part of our effort to protect that investment.”
