Classen Files Legal Action Against Strub/Alsapan
Kaisersesch, DE, September 5, 2017-Akzenta, a subsidiary company of the Classen Group, has filed legal proceedings against Strub/Alsapan for unpaid licensing fees on Classen’s Megaloc patent family, including its patent EP ‘210 at the Landgericht in Düsseldorf, Germany.
Classen is also condemning Välinge for misguiding Strub/Alsapan in this matter.
The legal filing is based on a settlement agreement reached between Strub/Alsapan (previously called EPI/Alsapan) and Classen in 2016. This settlement reconciled previous disputes and included the establishment of a direct, royalty-bearing license between the parties for Strub/Alsapan’s use of the Megaloc patent family. Shortly after signing this agreement, Strub/Alsapan changed its products from ZipNGo to Välinge’s 5G and abstained from reporting as well as paying for these volumes to Classen. This took place regardless of decisions made by several courts stating that the 5G system falls under Classen’s family of Megaloc patents.
Separately to the filing, Classen is accusing Välinge of deliberately circumventing its contract with Classen by striking a separate 5G licensing agreement designed to receive fees directly from Strub/Alsapan. Välinge knowingly undertook this despite being fully aware that 5G falls under the Classen Megaloc patent family, thus exposing Strub/Alsapan to infringement issues.
