CAN Court Grants Injunction Against Importer Infringing on Unilin IP
Wielsbeke, Belgium, November 18, 2016—The Canadian Federal Court has granted a permanent injunction against a large Canadian importer, MGA Commodities, prohibiting the import and sale of flooring products infringing Unilin’s IP rights.
The permanent injunction follows an earlier preliminary injunction, where the court also, upon Unilin’s request, ordered bailiff searches and seizures. The searches and seizures were conducted in the Quebec warehouses and stores of the importer allowing bailiffs to seize evidence of infringement, including physical evidence, electronic sales and import records, without notice to the importer.
